Application procedures and documents required

The applicant should submit the following to the Medical Activity Licensing Division:

A medical advertisement application letter to the director of the Health Bureau;
Identification information of the applicant;
Indication of the advertising media to be used, including the way of advertising and the text and images used in transmitting the message;
Relevant documents which prove the veracity of the advertising content.

Mondays to Thursdays: 9:00am-1:00pm, 2:30pm-5:45pm
Fridays: 9:00am-1:00pm, 2:30pm-5:30pm
(Closed on Saturdays, Sundays and public holidays)

Fees

Not required.

Application Processing Time

The vetting and approval of signs and billboards of private clinics and premises providing healthcare service will be completed within 10 working days. (not including: 1) applications where the name of the premise requires examination by the Private Medical Activity Licence Technical Committee, and 2) the time for posting or collection) (Performance Pledge)

Remarks/Notes for Application

The approval decision will be made in a maximum period of 30 days from the receipt of application;
In case the advertising content requires technical opinions from other professional departments, the above-mentioned period will be prolonged accordingly;
In case the application is declined, the applicant may appeal in accordance with general provisions.

Sanctions

Pursuant to Article 26 of Decree-Law no. 84/90/M of 31st December, which was amended by Decree-Law no. 20/98/M of 18th May, the letters, envelops, prescriptions and other documents or papers used by licensed professionals and entities must contain, in both Portuguese and Chinese, the name or designation adopted by the licensee, as well as the profession or business as indicated on the permit or licence. Besides, the advertisements, signs and billboards used by a clinic or a premise may only contain the contents as specified in the mentioned Decree-Law, while all boastful and ambiguous advertisements are prohibited. According to Article 23 of the same Decree-Law, any proven non-compliance with the provision of paragraph 1 of Article 26 shall be punishable by a fine of MOP 1,000-2,000, and the violation of paragraphs 2 and 3 under the same Article shall be punishable by a fine of MOP 2,000-10,000.
Pursuant to paragraph 1 of Article 16 of Law no. 7/89/M dated 4th September, any advertisements promoting prostheses, medical or paramedical therapies and objects or approaches presented as having health benefits, must be authorized in advance by the Health Bureau. In the event of confirmed non-compliance, the offender shall be liable to a fine of MOP 4,000-12,000 under Article 27 of the mentioned Law.
Under Law no. 7/89/M of 4th September, it is stipulated in Article 3 that, the advertising message should be lawful, identifiable, authentic and compliant with the principles of free and fair competition and consumer protection; paragraph 1 of Article 6 provides that the advertising message should respect the truth, neither distort the facts nor mislead the advertisement recipients; and paragraph 2 of the same Article prescribes that any descriptions relating to the origin, nature, composition, properties and conditions of acquisition of the advertised goods or services shall at all times be subject to proof. Pursuant to paragraph d) of Article 31 of the same Law, violators of the above stipulations will be subject to a fine enforced by the Economic Services.
