The Office of the Government Spokesperson declared at a press conference on 7 December that, according to the Land Law and its related stipulations, the land concession of Pearl Horizon Lot P will be voided upon its expiry on 25 December 2015. Facilitated by the Spokesperson of the Government, Mr Victor Chan, the press conference was held at the Government Headquarters. Those present included Secretary for Administration and Justice, Ms Chan Hoi Fan; Director of the Legal Affairs Bureau, Mr Liu Dexue; Director of Financial Services Bureau, Mr Iong Kong Leong; President of Executive Committee of Consumer Council, Mr Wong Hon Neng; and Director of Land, Public Works and Transport Bureau, Mr Li Canfeng. The Government has been highly concerned about the land concession issue of the Pearl Horizon project. A special taskforce was formed by the Secretariat for Administration and Justice, the Secretariat for Economy and Finance, and theSecretariat for Transport and Public Works, to explore solutions for the land concession issue of Pearl Horizon. In accordance with legal procedures, and strictly adhere to the principle of administrative legality, the Government has drawn up a plan to deal with the land concession case of Pearl Horizon. The land concession of Pearl Horizon Lot P is temporary in nature. In view of its construction progress, the grantee will not be able to fulfil the use of land withinthe concession period according to law. Therefore, in accordance with the stipulations of the Land Law, and in consideration of the usual practice of similarprecedents, the Government declares according to law the aforesaid land concession will be voided upon its expiry. As for those who have purchased the uncompleted flats, the Government will offer them with adequate protection and assistance out of good intention under the premise of legality. According to the existing Civil Code and relevant laws and regulations, the party concerned may take action to protect its interest through various channels according to the terms and conditions given in the pre-sale contract, including court proceedings. The Government sympathises with the uncompleted flat buyers’ situation and feeling, and hopes they will express their appeals rationally. The Government, under the current situation, will make its best effort to offer assistance to the uncompleted flat buyers, including free legal consultancy services.
