Change of Establishment Facilities


How to Process

Online application: Log in to “Business & Associations Platform” for processing (Applicants must have an individual or entity account of “Macao One Account”)

Note:
1. For samples of application documents, individuals can log in to “Business & Associations Platform > One-stop > One-stop service for license for food and beverage establishments > Preliminary evaluation/Service application” for download.

Application made in person

Required Document:

1. Application form “Pedido de Nova Licença” (Application for New License) (MOD.001/DLA/DHAL) and “Questionário para Estabelecimento Similar” (Questionnaire for Similar Establishment) (MOD. 006/DLA/DHAL) which can be obtained free of charge from the One-stop Licensing Service for Food and Beverage Establishments of IAM or downloaded from the IAM website www.iam.gov.mo; (not required for online applications)
2. Menus;
3. The plan of alteration works is required to be submitted along with the completed application form of the Land and Urban Construction Bureau (DSSCU) (The form can be obtained free of charge from the One-stop Licensing Service for Food and Beverage Establishments of IAM or downloaded from the website of DSSCU www.dsscu.gov.mo.);
4. The following explanatory documents and drawings are required to be provided in the plan of alteration works: Construction works conducted in the unit to facilitate the business operation, including renovation, reconstruction, preservation and repair works, as well as the construction periods of such works;
5. Location plan with a scale of 1:1000;
6. Floor plan, sectional drawing and elevation of the following drawings with a scale of 1:100: approved drawings, amended drawings and combined drawings;
7. Water supply plan with a scale of 1:100;
8. Drainage and sewerage plan with a scale of 1:100, including detailed drawing of grease interceptor;
9. Floor plan of fire service equipment with a scale of 1:100;
10. Drawing of fire service system with a scale of 1:100;
11. Notarised copy of drawings issued by DSSCU;
12. Responsibility declaration of plan compilation technician;
13. Responsibility declaration of project supervision technician;
14. Responsibility declaration of project execution;
15. If the applicant is an individual, a clear photocopy of the identification document is required to be submitted; (not required for online applications)
16. If the applicant is a legal person, a photocopy of the valid Business Registration Certificate (exemption for companies registered at the Commerce and Movable Property Registry of Macao) and a clear photocopy of the identification document of the legitimate representative of the company are required to be submitted, or if it is within 15 days since the document for the establishment of company is signed, a photocopy of that document or a clear photocopy of the “Official Gazette of Macao Special Administrative Region” which publishes the establishment document of the company can be submitted; (not required for online applications)
17. If non-Macao residents are employed in the establishment, relevant supporting documents are required to be submitted;
18. If the name of the establishment is the same as the existing hotels or similar establishments or may lead to confusion to a certain extent, agreement / certification document of the trademark of that establishment is required to be submitted;
19. Supporting document of right of use of establishment (e.g. tenancy contract or declaration);
20. Authorisation letter (If you opt to submit an electronic authorisation letter, you may create one with the “authorisation letter signing service” on the Business & Associations Platform. In that case, the applicants and all representatives are required to undergo facial recognition when submitting the application. If you opt to submit an authorisation letter where the signature has been recognised by Cartórios Notariais, only one of the representatives is required to undergo facial recognition when submitting the application. After that authorisation letter is uploaded to the Business & Associations Platform, the original copy must be produced or submitted at the one-stop service agency located at Avenida da Praia Grande, n.os 762-804, Edifício China Plaza, 2.º andar, Macau within 3 working days after the date of application submission to complete the application procedures.)

Note:
1. The above-mentioned documents are required to be submitted in nonuplicate. If the establishment intends to employ over 30 employees, or it is located in an area of historical monuments, an extra copy of the documents is required to be added accordingly. During the process of license application, the Division of Administrative Licensing may request the provision of other required information depending on the actual situation.

Document to be produced: The original or notarised copy of the identification document which bears the signature of the applicant or the legitimate representative is required to be produced.


Fees 

Online application

Application fee: The procedure fee is MOP1,000.00.

Note: In accordance with the stipulation of Article 23 4) of Administrative Regulation no. 16/2003 amended by Administrative Regulation no. 36/2018

Application made in person

Handling fee for inspection: MOP500.00

Note: In accordance with the stipulations of Order no. 83/96/M


Time Required for Approval

Online application: If the applicant submits all required documents that meet the standards within the designated time, the statutory time for approval review is 40 working days, excluding the construction period.

Application made in person: If the applicant submits all documents which meet the standards within the designated period, the time for approval is about 70 days, excluding the time for application for license for works and the construction period.


Location and Office Hours for Processing the Service

Division of Administrative Licensing: Avenida da Praia Grande, n.os 762-804, Edifício China Plaza, 2.º andar, Macau (One-stop Licensing Service for Food and Beverage Establishments)
Office hours: Monday to Friday, 9:00 a.m. to 6:00 p.m. (no lunch break, closed on Saturday, Sunday and public holidays) 


Remarks / Important Notes on Application

1. Applications made by online processing are required to be regulated by Decree-Law no. 16/96/M as amended by Law no. 8/2021Order no. 83/96/M and Administrative Regulation no. 16/2003 as amended by Administrative Regulation no. 2/2024

2. The person concerned can make the application in person or authorise a representative to make the application;

3. The successful completion of the procedure depends on whether the applicant can make correction to the improper items or provide supplementary information on time;

4. The fee for license renewal after the statutory period is MOP4,000.00;

5. In accordance with the stipulation of Article 31 of Decree-Law no. 16/96/M amended by Law no. 8/2021, IAM may initiate the procedure for cancellation of the license according to any of the situations (https://bo.io.gov.mo/bo/i/96/14/declei16.asp);

6. After the license is issued, the person in charge of the establishment should inform the licensing entity of the price lists to be implemented;

7. The application for endorsement of change of ownership should be made by the individual or legal person that accepts the transfer of ownership to the Division within 60 days counting from the day when such transfer is confirmed;

8. In accordance with the stipulation of Article 30 of Decree-Law no. 16/96/M amended by Law no. 8/2021, similar establishments can only be open to the public after the license is issued.


Progress enquiry and collection of result of service

Online application: Log in to “Business & Associations Platform” for enquiries

Application made in person: If applications made on or before 23 Abril 2024, application for change of establishment facilities, applicants can log in to “Macao One Account” for enquiries.

Method for collecting result of service

1. In person

If the license holder/authoriser collects the license in person, he or she (individual) is required to produce his or her original identification document; a legal person (establishment) is required to produce the original identification document of the person concerned in accordance with the signature on the Business Registration Certificate for collection;

If the license is to be collected by a representative, bring the receipt or produce the original identification document of the license holder.

2. Downloading license from Internet

During the valid period of the License for Food and Beverage Establishments, the license holder may download the latest license via “Business & Associations Platform” on his or her own. (A license holder must have an individual or entity account of “Macao One Account”)
