Change of License Holder


How to Process

Deadline for application: Within 60 days counting from the day of confirmation of change of ownership

Application procedure and required documents:

1. Application form (Form A). The form can be obtained free of charge from IAM or downloaded from the IAM website www.iam.gov.mo. The applicant is required to sign on each page of the downloaded form;

2. Valid license transfer contract / assignment / declaration (photocopy);

2.1  The content of the license transfer contract / assignment / declaration is required to include (but not limited to) the following information:

2.1.1  Identification information, contact information, etc. of both parties of the transfer;

2.1.2  Information about the establishment, such as license number, name of establishment, type and category of establishment, establishment address;

2.1.3  Terms of transfer;

2.1.4  Effective date of contract;

2.1.5  The signatures of both parties of transfer are required to be notarised.

3. If the new license holder is an individual, a clear photocopy of the identification document is required to be submitted. If the new license holder is a legal person, a photocopy of the valid Business Registration Certificate (exemption for companies registered at the Commerce and Movable Property Registry of Macao) and a clear photocopy of the identification document of the legitimate representative of the company are required to be submitted, or if it is within 15 days since the document for the establishment of company is signed, a photocopy of that document or a clear photocopy of the “Official Gazette of Macao Special Administrative Region” which publishes the establishment document of the company can be submitted;

4. Latest menus and prices in use (Submission date is required to be stated on the price lists.);

5. Food and Beverage Establishment – Declaration of Establishment Facilities (MOD.026/DLA/DHAL);

6. Supporting document certifying that the commercial solid waste generated is transported to the Macao Refuse Incineration Plant in Taipa for disposal by a hired cleaning company or the establishment itself. (Garbage collection time should be clearly stated on the supporting document.)

Documents to be produced:

1. The original or notarised copy of the identification document which bears the signature of the applicant or the legitimate representative;

2. The original or notarised copy of the license transfer contract / assignment / declaration.


Location and Office Hours for Processing the Service

Division of Administrative Licensing: Avenida da Praia Grande, n.os 762-804, Edifício China Plaza, 2.º andar, Macau (One-stop Licensing Service for Food and Beverage Establishments)

Office hours: Monday to Friday, 9:00 a.m. to 6:00 p.m. (no lunch break, closed on Saturday, Sunday and public holidays)


Fees

Not applicable


Time Required for Approval

10 working days counting from the day when all documents for application are submitted and relevant requirements are fulfilled. If consultation with other entities is needed, that period is not included in the time for approval.


Remarks / Important Notes on Application

1. Subject to regulation by Decree-Law no. 16/96/M amended by Law no. 8/2021 and Law no. 7/89/M;

2. The person concerned can make the application in person or authorise a representative to make the application;

3. In accordance with the stipulation of Clause 2 of Article 33 of Decree-Law no. 16/96/M amended by Law no. 8/2021, application for endorsement of change of ownership should be made by the individual or legal person that accepts the transfer of ownership within 60 days counting from the day when such transfer is confirmed;

4. If the applicant is an individual, the original identification document is required to be produced for verification upon application;

5. If the applicant is a legal person, the application form is required to be signed by the legitimate representative and the original identification document is required to be produced for verification. Moreover, a photocopy of the valid Business Registration Certificate (exemption for companies registered at the Commerce and Movable Property Registry of Macao) and a clear photocopy of the identification document of the legitimate representative of the company are required to be submitted;

6. The new license holder is required to make a new application for the License for Placement of Long-term Advertisements and Signboards with regard to the advertisements / signboards installed in the establishment. Offenders are punishable by a fine of between MOP2,000.00 and MOP12,000.00. The business name displayed in the establishment is required to be the same as the approved name.

Method for collecting result of service

1. In person

Bring the receipt and produce the original identification document of the person collecting the result.

2. Downloading license from Internet

During the valid period of the License for Food and Beverage Establishments, the license holder may download the latest license via “Macao One Account” on his or her own. (A license holder who downloads the license from the Internet must have an (individual or entity) account of “Macao One Account”. For details, please refer to: www.gov.mo/pt/services/ps-1047/.)
