How to Process

Deadline for application

In accordance with the stipulation of Clause 1 of Article 19-A of Administrative Regulation no. 16/2003 amended by Administrative Regulation no. 36/2018, the persons concerned who have started the procedure for First-time Application (Applicable to applications for opening food and beverage establishments in units of established buildings with appropriate operation licenses) can file an application for temporary license after approval of project review and completion of renovation of the establishment in compliance with the requirements of the approved plan so as to conduct the business of food and beverage / beverage establishments.

Processing procedure and required documents

1. Declaration on Application for Temporary License;

2. Declaration on Completed Works’ Compliance with Construction Plan by Builder / Construction Company Responsible for Implementation of Works;

3. Declaration on Completed Works’ Compliance with Regulations by Technician Responsible for Supervision of Works;

4. If the establishment is equipped with fire service system, a declaration on effective operation of the fire service system issued by a competent entity is required to be submitted to IAM (Please refer to Certificate of Fire Service System.);

5. If the establishment is equipped with fuel / fuel gas equipment, a declaration on the source of supply of fuel gas equipment and fuel, as well as the information for certifying the inspection of fuel gas equipment issued by competent entities are required to be submitted to IAM (Please refer to Certificate of Inspection of Fuel / Fuel Gas Equipment and Declaration of Supplier of Liquefied Petroleum Gas / Fuel.);

6. If the establishment is equipped with elevator equipment, the valid documents for “Certificate of Safe Operation of Elevator Equipment” (original, copy and other relevant documents) are required to be submitted to IAM. For details, please refer to the “Instructions for Review, Approval, Inspection and Operation of Elevator Equipment of Private Constructions” (website: www.dsscu.gov.mo/pt/home/information/id/169).

Note: The samples for reference of the above-mentioned declarations and certification documents can be obtained free of charge from the One-stop Licensing Service for Food and Beverage Establishments of IAM or downloaded from the Download section of the thematic website of One-stop Licensing Service for Food and Beverage Establishments of IAM https://www.iam.gov.mo/onestop-fnb/e/downloadform/list.aspx.

Document to be produced: The original or notarised copy of the identification document which bears the signature of the applicant or the legitimate representative is required to be produced.

Application fee: Not applicable

Stamp duty: Not applicable

Security deposit: MOP10,000.00, to be paid upon approval of application

Time Required for Approval

8 working days counting from the day when all documents for application are submitted and relevant requirements are fulfilled


Remarks / Important Notes on Application

1. Subject to regulation by Decree-Law no. 16/96/M amended by Law no. 8/2021 dated 1 April and Administrative Regulation no. 16/2003 amended by Administrative Regulation no. 36/2018;

2. The person concerned can make the application in person or authorise a representative to make the application;

3. The successful completion of the procedure depends on whether the applicant can make correction to the improper items or provide supplementary information on time;

4. A temporary license cannot be transferred in the same way as the normal license during its valid period; 

5. The temporary license can only be issued once during the application period and renewal is not allowed;

6. If the one-stop service agency issues a temporary license of Article 19-A of Administrative Regulation no. 16/2003 amended by Administrative Regulation no. 36/2018 in response to the application made by the person concerned, the temporary license referred to in Clause 1 of Article 19 will not be issued again during the licensing procedure;

7. In accordance with the stipulation of Article 30 of Decree-Law no. 16/96/M amended by Law no. 8/2021 dated 1 April, a similar establishment can only be open to the public after the license is issued;

8. After the license is issued, the person in charge of the establishment should inform the licensing entity of the price lists to be implemented;

9. If the applicant is an individual, the original identification document is required to be produced for verification upon application;

10. If the applicant is a legal person, the application form is required to be signed by the legitimate representative and the original identification document is required to be produced for verification. Moreover, a photocopy of the valid Business Registration Certificate is required to be submitted (exemption for companies registered at the Commerce and Movable Property Registry of Macao);

Method for collecting result of service

1. In person

Bring the receipt and produce the original identification document of the person collecting the result.


Refund of Security Deposit

Processing procedure and required documents for refund of security deposit

1. Application Form for Refund of Security Deposit (Food and Beverage Establishment – Temporary License) (MOD.033/DLA/DHAL);

2. Original temporary license;

3. Original receipt of payment of security deposit (If the receipt is lost, a declaration is required to be made.);

4. If the applicant is an individual, a photocopy of the identification document of the signatory is required to be submitted;

5. If the applicant is a legal person, a photocopy of the valid Business Registration Certificate (exemption for companies registered at the Commerce and Movable Property Registry of Macao) or a photocopy of the valid Certificate of Association issued by the Identification Services Bureau is required to be submitted. The application form is required to be signed by the legitimate representative and a photocopy of the identification document of the signatory is required to be submitted;

6. If the cheque is made payable to a name different from the applicant’s name, a photocopy of the identification document or the Business Registration Certificate of the payee is required to be submitted (exemption for companies registered at the Commerce and Movable Property Registry of Macao);

7. If the applicant applies for refund of security deposit by bank transfer, a photocopy of the bank document bearing the payee’s account number (e.g. passbook or monthly statement) is required to be submitted.

Document to be produced: The original or notarised copy of the identification document which bears the signature of the applicant or the legitimate representative is required to be produced.

 

Circumstances of refundable security deposit:

 1. The person concerned is granted a License for Food and Beverage Establishments;

2. The person concerned withdraws the application for License for Food and Beverage Establishments;

3. The one-stop service agency approves the application for change of project made by the person concerned;

4. The valid period of the temporary license expires;

5. The person concerned applies for revocation of temporary license. 

 

Circumstances of non-refundable security deposit:

 1. The operation of the food and beverage establishment has severe impact on public safety, public health and environmental protection;

2. The person concerned violates the restrictions of the license and does not make correction within the period designated by the one-stop service agency.
