How to Apply
Application Eligibility
1. Being a Macao resident with legal capacity, or the company, association or foundation being established according to law and having domicile of legal person located in the Macao Special Administrative Region;
2. The business premise to be used shall meet the legal requirements;
3. Having fulfilled the tax obligations if any;
4. Having proper moral integrity to conduct business;
5. Having technical and organizational capabilities;
6. In the case of conducting the fee-charging employment agency activity, an effective guaranty has been provided;
7. Not within the period of additional penalties in which the employment agency activity is prohibited.
Application Procedures and Required Documents:
1. The “Employment Agency Activity Licence and Branch Licence Application Form” duly completed (the form can be obtained from the Labour Affairs Bureau or downloaded from its website);
2. A copy of the identification documents of the applicant or the interested persons provided for in subparagraphs (3) and (4) of paragraph 3 of Article 6 of Law No.16/2020;
3. Where the applicant is a company, the business registration certificate is required, including a copy of the company’s establishment documents and its Articles of Association properly updated; in the case of a joint stock limited company, a list of all shareholders holding 10% or more of the capital and relevant supporting documents shall be submitted;
4. Where the applicant is an association or a foundation, certificate of registration and leadership structure issued by the Identification Services Bureau;
5. Criminal record certificates of the applicant or the interested persons provided for in subparagraphs (3) and (4) of paragraph 3 of Article 6 of Law No.16/2020 (the purpose of the criminal record certificate is to apply for the employment agency activity licence);
6. Personal resume with educational background and work experience of the applicant or any of all the administrators and shareholders of the company/all the principal persons of the organ of the association or foundation/the appointees of the association, and a copy of relevant supporting documents; in the case of the designated person appointed by the association, the minutes of the meeting must also be submitted;
7. Documents issued by the Financial Services Bureau to prove that the applicant has fulfilled or exempted from tax obligations;
8. A written report on the real estate registry of business premise to be used;
9. If the place of origin of the non-local resident to be recruited or provided job referral service is Mainland China or Vietnam, supporting documents showing the qualification in providing exportation of labour service recognized by the local authorities or a notarized copy of such documents must be provided;
10. Other appropriate documents or information deemed to be useful for assessing application requested by the Labour Affairs Bureau.

Fees
MOP30, 000.00
The fees shall be calculated according to the proportion of the licence period; in addition, the fees must be paid in the form of bills; both a bank crossed cheque and a cashier’s order are acceptable, which shall be payable to “Fundo de Segurança Social” (the Social Security Fund).
Application Processing Time
Application for conducting fee-charging employment agency activity:
1. Processing time: 30 days (upon receipt of all necessary documents)
2. Time to submit bank guaranty: 45 days (upon receipt of submission of bank guaranty notice)
3. Licence issue time: 15 days (upon receipt of bank guaranty)
Application for conducting non-fee-charging employment agency activity:
Time to process and issue licence: 30 days (upon receipt of all necessary documents)
Remarks/Notes for Application
Persons who are not in any of the following circumstances shall be deemed to have proper moral integrity to conduct business:
1. Having been sentenced to imprisonment of 3 years or more, except those whose rights have been restored in accordance with the law;
2. Having the licence cancelled in accordance with the provisions of subparagraph (10) of paragraph 1 of Article 19 within one year prior to the date of submission of the application.
Persons who fulfil the following conditions concurrently shall be deemed to have technical and organizational capabilities:
1. With a high school diploma or above;
2. With minimum 3 years’ experience in human resource management and job referral or related activity.
The interested persons provided for in subparagraphs (3) and (4) of paragraph 3 of Article 6 of Law No.16/2020 include:
1. All the administrators and shareholders of the company; in the case that the shareholder is a legal person, all its administrators or the principal persons of the organ;
2. The administrators and the shareholders holding 10% or more of the capital of the joint stock limited company; in the case that the shareholder is a legal person, all its administrators or the principal persons of the organ;
3. All the principal persons of the organ of the association or foundation; however, in the case that the association is in accordance with the law or its articles of association and the designated person who is appointed by the competent authority through a resolution of the meeting to engage in the employment agency activity, all of its principal persons of the organ and the appointee.
Requirements of business premise:
1. The fee-charging employment agency shall be located in real estate used for commercial, service or office building purposes; the non-fee-charging employment agency shall be located in real estate used for commercial, service or office building, social and collective purposes;
2. Shall not be located in any other establishments engaged in the employment agency activity;
3. Have an independent space with independent entrance and exit, for conducting employment agency activity only;
4. Have a reception area for service users;
5. Have the appropriate conditions referred to in other laws and regulations on work health and safety in business premises.
Bank guaranty:
Within 45 days from the date of receipt of the notice given by the Labour Affairs Bureau, the applicant of the fee-charging employment agency who meets the requirements for the issue of licence shall provide a guaranty of MOP300,000.00 issued by the bank operating in the Macao Special Administrative Region and the beneficiary entity shall be the Labour Affairs Bureau.
Validity of licence:
The licence is valid for 2 consecutive calendar years from the issue date of the licence until December 31 of the following year.

Methods of Service Result Collection: Collect in person, by post or download the digital licence through the Common Access to Public Services of the Macao SAR (Entity) electronic platform
Presenting the identity card and payment of fees are required during collection (only the fee-charging employment agencies are required to pay the fees).
