How to Apply

Time of application

In possession of a letter issued by the “Liaison Office” or the “Office of the Commissioner” requesting for reissue of a Special Stay Permit for the applicant.

Application procedures and documents required

  1. People making the application
    1. Holders of a Special Stay Permit;
    2. Legal representative of the applicant (Remark: 1.)
  2. Documents Must be Presented
    1. Unless otherwise noted, the original should be exhibited for authentication if a copy is submitted;
    2. The copy should be authenticated if the original cannot be exhibited.
  3. Necessary Documents
    1. A completed Declaration / Application Form ( DARP/DARP M-3) [[Note: The application form is available at the respective Subdivision and the website of the Public Security Police Force];
    2. Letter issued by the “Liaison Office” or the “Office of the Commissioner”
    3. Copy of the bio data page of the “Permit for Travelling to and from Hong Kong and Macao for Business Purpose” (“Two-way Exit Permit for Business Purpose” for short) and the inside page affixed with the latest and valid endorsement;
    4. 2 recent colour photos of 1.5-inch, full face, no-hat, white-background;
    5. “Report Testimonial” or “Complaint Notification” issued by a police department (if the Special Stay Permit is lost, stolen, plundered, etc.);
    6. Statement of the employing organization declaring that they are still employing the applicant (Remark 2.);
    7. Declaration of the applicant stating that he or she is still employed by the organization;
    8. Original of Special Stay Permit (Remark 3.).
  4. Upon completion of the formalities, a Revenue Receipt will be issued. The person making the application should bring the Revenue Receipt to the Subdivision on the designated date of collection specified on the Revenue Receipt or after he or she receives an SMS from the Subdivision (applicable only to persons who have chosen this notification service) to collect the Special Stay Permit.

Remark:

  1. The legal representative is required to submit a certified letter of authorization and a copy of his/her valid identification document (the original should be exhibited for authentication).
  2. The statement should contain the personal information of the applicant, organization stamp and signature of the person in charge at the organization.
  3. In the case that the Permit is damaged.

Charge

According to Article 43 of Administrative Regulation No. 38/2021, the charge for reissuing a Special Stay Permit is double the normal charge. However, if there is a reasonable explanation for applying for a reissue, especially when the loss or damage is not attributable to the holder, the charge will be half of the normal charge.

Note: According to the Chief Executive’s Written Instructions No. 173/2021, staff of the official representations of the Central People’s Government of the People’s Republic of China is exempted from paying the fee for the Permit.

Remark / Requirements

  1. According to Term 1, Article 66 of Law No. 16/2021, to apply for a visa, Authorization to Enter and Stay, Macao SAR Residence Authorization, Renewal or Extension of Residence Authorization means the interested person consents to have his or her personal information, which includes his or her biodata, treated by the Public Security Police Force.
  2. Date of issue and validity period of Special Stay Permit
    1. Date of Issue: Same as the date of approval by the examination authorities;
    2. Validity Period:
      1. The validity of the Special Stay Permit generally depends on the working period and is based on the endorsement in the Permit for Travelling to and from Hong Kong and Macao.
      2. The Special Stay Permit can be renewed.
  3. According to the laws and regulations of Macao, holders of a “Two-way Exit Permit for Business Purpose” and a working endorsement to Macao (or stationing endorsement to Macao) are allowed to stay in Macao within the validity period of the endorsement. However, the limit of stay per entry is a maximum of 90 days. If the limit of stay (90 days) granted to the interested person upon his or her last entry to Macao is expiring during his or her application for a Special Stay Permit, the interested person may apply to the Residence and Stay Affairs Department of the Public Security Police Force for extension of the Authorization to Stay. Otherwise, overstay may be resulted.
  4. Non-resident workers / their dependants / Special Stay Permit holders who have their passport / travel document / “Two-way Exit Permit” / identification document which was used to apply for the relevant Authorization to Stay replaced are required to bring the document to the Subdivision concerned for information update and reissue of Slip of Authorization to Stay.
  5. Penalty for Overstay
    According to Article 58 of Law No. 16/2021 “Legal Regime of Immigration Control, Stay and Residence Authorization of the Macao Special Administrative Region”, non-residents who overstay not because of non-imputable justified reasons will be deported and may be interdicted from entry and prohibited from making applications for Residence Authorization or Special Authorization to Stay for two years starting from the expiry of the entry interdiction period. If a non-resident overstays for not more than 30 days, is not a repeated offender of such infraction and pays the minimum fine (MOP500 per overdue day) upon giving himself or herself to the police or immediately after he or she is discovered, the above stipulation is not applicable. In addition, according to Article 94 of Law No. 16/2021, repetition of the same infraction within 1 year from the date the decision of administrative penalty becomes unappealable and any new administrative infraction committed within 5 years from the previous infraction are considered to be recidivism.
