THE NOTICE OF PROSECUTION FOR OFFENCES OF THE LAW NO. 6/2023 “REGIME OF PREVENTION AND CONTROL OF UNDERAGE ALCOHOL CONSUMPTION” (HEREAFTER REFERRED TO AS “LAW NO. 6/2023”)- GUIDELINES FOR PAYMENT OF FINES

Important notes
- Within 15 days from the day of receiving the notice of prosecution, offenders may make a voluntary payment or submit a written defence.
2.1 Voluntary payment
This is applicable to fines as stipulated in items (1) and (4) of clause 1 of article 11 of Law no. 6/2023. If offenders settle the payment voluntarily within the above period, they are obliged to pay only half of the fine. Beyond the above stipulated period, they are required to pay full amount of the fine. Once offenders have made a voluntary payment, it is supposed they abandon the right of submitting a written defence.
2.2 Written defence submission
For objection against the notice of prosecution, offenders may submit a written defence (personally or by post) to the Tobacco and Alcohol Prevention and Control Office during the above stipulated period. The concluded proceedings will be submitted to the director of the Health Bureau for penalty application or filing. Once the decision of penalty has been made, offenders are required to pay the fine amount in full.
3. In pursuant to article 17 of Decree Law no. 52/99/M, failure to settle the penalty payment within the stipulated period of time may result in a compulsory collection of the fine according to the tax execution procedure by competent authority with proof of the penalty decision.
4. In pursuant to article 18 of Decree Law no. 52/99/M, non-Macao SAR resident offenders can be denied re-entry into the territory of Macao before they have settled their fines.
5. If the notice of prosecution is lost, offenders may pay their fines at the Tobacco and Alcohol Prevention and Control Office after 5 working days from the day receiving the notice.
