How to Apply
Time of Application
Parents granted any type of Authorization to Stay are required to prove to the competent department of the Public Security Police Force or any checkpoint that they have obtained a passport, travel document or other documents accepted for the purpose of immigration control for their children within 90 days after their birth. The period for declaration can be renewed or extended depending on the situation and after reasons are given.
Note: The obligation does not have to be fulfilled if the new-born baby departs legally from the Macao Special Administrative Region within the period.
Application Procedures and Documents Required
- Application Approach
- Interested person or a legal representative making the application;
- The representative should submit the following:
- A certified letter of authorization;
- A copy of his/her valid identification document.
- Documents to be Presented
- Unless otherwise noted, the original should be exhibited for authentication if a copy is submitted;
- The copy should be authenticated if the original cannot be exhibited.
- Documents to be Submitted
- A completed Declaration of Non-resident Children Born in the MSAR (DARP/SP/ M-2);
[Note: The Declaration is available at the subdivision concerned and the website of the Public Security Police Force.] - A copy of the interested person’s valid identification document or passport/travel document (bio data page and used pages only, as well as Slip of Authorization to Stay granted in last entry to Macao) used for stay in Macao;
- Original and a copy of the children’s passport, travel document or other documents accepted for the purpose of immigration control;
- A copy of the Certificate of Narrative of Birth Registration issued by the Macao Civil Affairs Registry.
- A completed Declaration of Non-resident Children Born in the MSAR (DARP/SP/ M-2);
- Forms: Declaration of Non-resident Children Born in the MSAR (DARP/SP/ M-2)

Remark/Points to Note
- According to Term 1, Article 66 of Law No. 16/2021, to apply for a visa, Authorization to Enter and Stay, Macao SAR Residence Authorization, Renewal or Extension of Residence Authorization means the interested person consents to have his or her personal information, which includes his or her biodata, treated by the Public Security Police Force.
- According to Article 31 of Law No. 16/2021, if parents who are granted any type of Authorization to Stay fail to comply with the obligation stipulated in this article because of fault, their Authorization to Stay will be revoked. In addition, application for Residence Authorization and Special Authorization to Stay will not be permitted for 2 years counting from the date of expiry of the period of default.
- According to Article 49 of Law No. 16/2021, if there is a fault in the person who has parental rights or guardianship regarding the status of illegal immigration or illegal stay of an unemancipated minor, the person will be fined MOP3000 to MOP9000. If the liable person is a non-resident, the fine will be replaced by revocation of his or her Authorization to Stay and prohibition from applying for Residence Authorization and Special Authorization to Stay for two years.
- Penalty for Overstay
According to Law No. 16/2021 “Legal Regime of Immigration Control, Stay and Residence Authorization of the Macao Special Administrative Region”, persons who still remain in Macao after their Authorization to Stay expires and persons who do not leave Macao within the designated period after their Authorization to Stay is revoked are regarded as overstayers. Overstay is an administrative infraction, not a criminal offence. Therefore, overstayers are not condemned to a penalty of freedom deprivation.
According to the law, an overstayer will be fined MOP500 to 800 per overdue day. The fine should not exceed MOP15000 and should be paid within the statutory 10 working days. The status of an overstayer who overstays for not more than 30 days, pays the fine upon giving himself or herself to the police or immediately after he or she is discovered and has never been fined for the same infraction in the past year can be normalized. Otherwise, the overstayer will be deported and interdicted from entry. In addition, application for Residence Authorization and Special Authorization to Stay will not be permitted for 2 years counting from the date the entry interdiction expires.
