Service Content

In order to adapt to and meet the needs of social development, create conditions for investors and promote the development of the food and beverage industry, the Chief Executive promulgated Administrative Regulation no. 16/2003 and approved the amendments to the licensing procedure for food and beverage establishments of Category 4 and Category 5 referred to in Decree-Law no. 16/96/M on 7 July 2003, implementing the “one-stop licensing procedure”. Subsequently, a “document-based” temporary license system was introduced in Administrative Regulation no. 36/2018 promulgated on 27 December 2018 in addition to amendments and improvements to the licensing procedure for food and beverage establishments, facilitating applicants to commence their business at an earlier time.

As the “one-stop service agency”, the Municipal Affairs Bureau (IAM) is responsible for processing formalities directly related to the licensing procedure. Furthermore, it assists applicants in processing the required documents, drawings and formalities of other relevant public entities so as to simplify and improve the whole administrative procedure, raise the administration efficiency and enhance service quality of the whole procedure, striving to implement the “resident-oriented” service spirit.


Target Group of Service

In accordance with Decree-Law no. 16/96/M amended by Law no. 8/2021, the similar establishments belonging to Category 4 and Category 5 are as follows:

1. Establishments of Category 4 are the ones which serve beverages as the basic business and may also offer simple food items, such as cafés, ice cream parlours and tearooms.

2. Establishments of Category 5 are the ones which offer meal service but their facilities and equipment only meet the minimum statutory requirements and do not meet the requirements for restaurant category, such as congee and noodle shops, and bistros.


Eligibility for Application

Any individual or legal person is eligible for application.


Result of Service

1. Offering clear information and assistance in construction technique: The relevant information is explained in detail in forms such as the “Guidelines”, show flats and short videos. Through cross-departmental “technical meetings” between technicians from relevant departments and applicants, relatively complicated technical issues about constructions can be explained so as to allow applicants to have a clear understanding of the application details and technical requirements.

2. Centralised processing of the whole procedure as service agency: With the authorisation from applicants, IAM, as the one-stop service agency, provides assistance in processing all required formalities, including filing applications for required documents to other departments on behalf of applicants, such as applications for property registration reports, notarised copies of operation licenses, drawings, license for works and temporary operation license for electrical installations. IAM also informs the applicants of the progress of each procedure and the co-operation required so as to save the applicants’ time to visit other departments to process different formalities and enable them to have a clear idea of the status of the procedure.

3. Speeding up licensing to reduce business commencement costs: If applicants submit all documents which meet the standards within the designated period, the license can be obtained within 60 working days counting from the day of application submission, excluding the construction period. In addition, on the premise that there is no impact on public safety, public health and environmental protection, a temporary license may be granted to enable the applicants to commence business as soon as possible and reduce financial loss.

4. Addition of “document-based” temporary license system: On the premise that there is no impact on public safety, public health and environmental protection, applicants can file an application for a “document-based” temporary license after approval of project review and completion of establishment renovation according to the requirements in the approved plan. Upon submission of declarations and certification documents for satisfaction of the above-mentioned three requirements, a “document-based” temporary license can be issued, assisting in shortening the time for applicants to be granted a license.

5. Increase in flexibility of licensing procedures: After suspension of the licensing procedure for any reasons, an application for resumption of the suspended procedure can be made within a specified period provided that the conditions and requirements for reapplication are fulfilled.
